    Timber Buildings Terms & Conditions Definitions In these Conditions of Sale, the following terms shall have the following meanings: a) "The Company" refers to Newton & Frost. b) "The building(s)" means the building, erection, or construction, or the part or parts thereof, described in the Order, including all items incidental or ancillary thereto as specified in such Order. c) "The Customer" refers to the person or persons, firm, or company who has agreed to purchase the building(s). Variations No variation of these conditions shall apply unless confirmed in writing by the Company from its Head Office. No employee, other than a director, has the authority to verbally or in writing, agree to any variation of these terms. Payment A non-refundable deposit of 50% of the cost is to be paid at the point of sale, with the balance to be paid prior to delivery. The balance of payment is due to the Company once the customer has been notified by the Company of the agreed delivery date, provided that the agreed deposit has been paid to the selling agent. Payment can be made by credit card, debit card, bank draft, or personal cheque. The sums shall not be treated as paid until all cheques, bills, etc. have been honoured. Until the Company has been paid in full for the building(s), even though the risk shall have passed to the customer, the property of the building(s) shall not pass to the customer but remain vested in the Company until full payment has been received by the Company. Until such time, the customer shall hold the building(s) as Bailee for the Company. Failure to pay on time will delay delivery. In the event of default by the customer, the Company shall be entitled forthwith to repossess any building(s) which remain the property of the Company. The customer shall allow the Company access and entitlement to enter the premises where the customer is in occupation or to where any such building(s) may be for the purpose of such repossession. The customer shall only be at liberty to resell the goods purchased from the Company prior to the passing of title on the condition that it will hold on trust for the Company so much of the proceeds of the sale as are necessary to discharge payment in full to the Company. Order Details Where the customer requires a delay in the immediate processing of an order, the Company reserves the right to vary the price accordingly or request that the building(s) is/are paid for in full at the time of order, or the Company is notified of the customer's intention to delay the order. The Company reserves the right to make minor alterations to the specification without notice. Illustrations, photographs, descriptions, information, and statements contained in the Company's brochures and literature are intended only as a general guide and do not form any contract. Responsibility of the Customer It is the responsibility of the customer to ensure that all permissions, approvals, and other consents are obtained. The customer will keep the Company indemnified against all liability costs and expenses which may arise in the event of the building(s) being erected without any necessary permission, approval, or consent. Timber is naturally porous. Whilst the pressure treatment we use is to prevent the timber rotting, it does not make it waterproof. The customer bears the responsibility of ensuring that their building is treated with a good quality water resistant paint or stain after installation. NFF strongly recommend the use of a vapour barrier which must be fitted during the manufacturing process. NFF also strongly recommend that air vents are fitted as they promote proper air circulation within the building. Typographical and/or clerical errors or omissions shall be subject to correction. Delivery Terms and Conditions The customer must inform the Company of any overhead power cables, other services or obstructions that may cause injury or harm at the point of sale. The customer must provide complete and accurate address details for delivery. All dates and time periods given by the Company or selling agent are business estimates only. While the Company will make its best efforts to adhere to these estimates, the Company will not be held liable for any direct or consequential losses resulting from delays in delivery caused by the customer. The Company will not be held responsible for any delays caused by adverse weather conditions, transportation delays, or other causes beyond its control. Such delays shall not be a basis for order cancellation. The customer must notify the Company of any difficulties regarding access from the public highway to the delivery address, and the Company reserves the right to make an additional delivery charge in such cases. Failure to provide suitable access will result in the building being left as near as possible to the access point. The customer must ensure that there is adequate access to the delivery site during working hours (7.30am-5pm Mon-Fri) at the time of delivery. Failure to provide adequate access will result in the building being left at the front of the property. If the building was to be installed, the customer will be responsible for arranging their own installation at no reduction in cost from the Company. The customer must provide legal parking space for the Company's vehicles and any necessary permits or parking tickets. Installation Terms and Conditions The customer must ensure a minimum clearance of 600mm at the sides and rear of the building, 1.5m to the front and 1.5m above the roof for installation purposes. The customer must provide a clear working area, including the removal of shrubs, plants, trees, and cables as necessary. The customer is responsible for ensuring that the prepared base area is firm, level, of the correct size, and completed. Soil or turf is not adequate for permanent buildings. If, on arrival, the base area is unsuitable, the Company reserves the right to make an additional charge to cover labour and travel expenses. The customer is responsible for ensuring that concrete, groundwork, or brickwork plans are followed with a high degree of accuracy. The concrete and brickwork must be completed two weeks prior to installation. The Company will then require a site visit to check the work before installation can commence. The Company will ensure that reasonable care and skill are employed in carrying out the installation work. The Company may sub-contract the whole or any part of the work. The customer must inspect the building(s) upon delivery and notify the Company in writing within 7 days of any complaint that the building(s) is incomplete and/or damaged. Failing such written notification, the customer shall be deemed to have accepted the building(s) as complete and intact. Timber is a natural material that can absorb and release moisture. Under certain conditions, some movement is unavoidable. The Company cannot be held responsible for shakes, shrinkage, splits, and knots which are natural features of timber. The customer is responsible for treating untreated buildings as soon as possible following installation. The risk in the building(s) shall pass to the customer upon delivery to the designated address. The Company recommends that the customer maintains an adequate flow of air through the building to prevent condensation. The Company does not give any guarantee, warranty, or other representation against condensation. Any adjustments or repairs required for doors and windows are the responsibility of the customer. Our installers are happy to advise upon request while on-site. Self-install Buildings and Alterations The Company shall not assume any responsibility for self-install buildings, or any modifications made to the building by the customer. Adverse Weather Conditions The Company shall not be held liable for any damage caused by adverse weather conditions. Placement of Mobile Structures The Company may provide advice on the placement of mobile structures. However, the client shall bear ultimate responsibility for ensuring the location's suitability in all instances. All sites must be reasonably level, and if future re-positioning is intended, the customer should plan for how the movement can be achieved. It should be noted that mobile structures erected on ground that is out of level or undulating are more likely to suffer from structural or weathering problems over time due to the settlement of the structure into the land profile. Planning It is the customer's responsibility to ensure that the building complies with all planning and building regulations at all times. Changes to Terms and Conditions The Company may modify these terms and conditions from time to time and post a new version on the website, which supersedes all previous versions. It is the customer's responsibility to regularly check the latest version of the terms and conditions on the website. The Company recommends printing a copy of the terms and conditions for future reference. This shall not affect the customer's statutory rights

    ACCREDITATIONS ENVIRONMENTAL NOISE BARRIERS Newton and Frost have been designing and installing both reflective and absorptive noise attenuating environmental barriers for over twenty years. Our barriers have been acoustically tested in accordance with BS EN 1793 by a UKAS approved laboratory. We can supply both reflective and absorptive barriers of varying performance values, manufactured from a variety of materials, such as timber, aluminium, steel, acrylic and Greenscreen, which is ideal for supporting climbing plants. Once these plants are established the barrier has a completely natural appearance that blends into the landscape Absorptive Environmental Barriers This type of barrier is designed to reduce reflected noise which can be a problem in situations adjacent to busy roads, railways, and industrial premises with noisy machinery. Absorptive Barriers are often utilised in areas such as superstore service yards where loading and unloading are prevalent, and indeed in and around sports stadium and leisure complexes. In fact, in any area where noise may be a nuisance, installing an absorptive barrier is an excellent solution. Technical Information This type of barrier is installed using steel Universal Beams which are galvanised, and if required powder coated to the client’s specification. The posts will be installed into concrete foundations or fixed down using base plates and chemical anchors. Timber Timber components are FSC certificated and are treated with Tanalith E, giving them a long life expectancy, either 15 years or 30 years, depending upon your choice of specification. Panels We fabricate our panels in our new, purpose-built, manufacturing facility enabling us to be competitively priced, and have full control over the manufacturing programme and ultimately the quality of the product. Infill The infill that we use is mineral wool, which is covered by a breathable membrane. Finishes other than timber are available, whether steel sheet, perforated sheet or indeed any other design; we are able to fabricate to meet your requirements.
